Prizes and Fulfillment

Wawa makes no representation or warranty regarding any Prizes you may win and has no responsibility for Prizes except to arrange for the shipment as provided below. Wawa is also not responsible for any damages that may be caused while the Prize is in transit by the logistics company. This will be the sole responsibility of the logistics company and Wawa cannot be held liable in such case. Wawa will provide best effort to filter out defective Prizes by physical inspection prior to shipping. In the event that Prizes appear to be defective or damaged during transit despite photo evidence of external packaging being intact upon receipt, Wawa may compensate the winner with reasonable amount of Wawa Coins or Wawa eTickets using a formula that Wawa has predetermined. Failure to present photo(s) of the external packaging upon receipt may forfeit your right to claim for a compensation. You may not dispute the outcome of the compensation. Wawa is not a seller of the Prizes and will have no liability with respect to the Prizes, including under any theory of product liability. For branded Prizes, in the event of any defect, your sole recourse will be to make a claim against the manufacturer of the Prize.

You can win only 1 Prize per attempt on any machine, therefore in certain cases where you managed to win 2 or more Prizes in one attempt, Wawa will only honor 1 Prize.

Prize variant due to stock availability or differences in colors that are displayed through the machine’s cameras can not be used as a reason to claim for a compensation or substitution.Wawa will clearly mark certain machines with Prizes of random variants to be shipped in the item description. You are not entitled to request certain model, type, color, size, or variant of the Prizes.

Subject to your payment of any required shipping and handling fees, Wawa will ship Prizes to the address specified by you, within the region(s) specified in the Service. Upon delivery of the Prize to the shipping service, Wawa will have no further responsibility for the Prize. Your recourse for any damage in shipping will be limited to a claim against the shipping service. No shipping insurance will be provided. You will be responsible for any customs duties or procedures that may apply in your country. You will be responsible for any use tax, sales tax, value-added tax or other taxes that may apply.

If a Prize shipment is returned to us as undeliverable, we may (but are not obligated to) contact you to try to arrange for reshipment. If we do contact you and you don’t respond within 24 hours, the Prize will be forfeited.

For fraud prevention purposes we may require first-time users and certain other users to provide a valid billing account for identity verification purposes within a certain time after winning a prize.

Users who fail to follow these or other procedures announced by Wawa will forfeit any prize they may have won. CREDIT CARD INFORMATION THAT YOU PROVIDE FOR VERIFICATION PURPOSES WILL BE TRANSFERRED TO A THIRD-PARTY PAYMENT GATEWAY AND WILL NOT BE RETAINED BY Wawa. Wawa will only retain “token” or “hash value” information regarding the credit card, which may not be used to identify you, extract personal or credit card information or (by itself) process any payment.

If you do not request shipment of any Prizes within a certain period time (notified in the Service) and provide a shipping address, you will forfeit any right to the Prizes, and Wawa will not ship them to you.

Virtual Currency, Including Wawa Coins, Wawa Tickets, and Virtual Goods

The Service may include “virtual currency,” consisting of “Wawa Coins”, “Wawa Tickets”, tokens, points or similar items that may be earned or obtained through the Service or otherwise purchased by you for actual (“real-world”) currency, subject to applicable law. The Service may also include “virtual goods,” consisting of digital items such as commodities, abilities or other goods that may be earned or obtained through the Service or otherwise purchased by you for actual currency, or for virtual currency, subject to applicable law.

We can manage, regulate, control, modify or eliminate virtual currency and/or virtual goods, including the price thereof, at our discretion, and will have no liability to you or any third party for any of such actions. You have no right, title or interest in or to any virtual goods or virtual currency except the following: a limited, personal, non-transferable, non-sublicensable, revocable license to use, solely within the Service, virtual goods and virtual currency that you have earned, purchased or otherwise obtained in a manner authorized by us.

Wawa Coins, Wawa Tickets, or other virtual currencies may expire after a certain period of time, as we may provide in the Service. Any information related to changes on expiry time will be announced through the app and social media account (Instagram). You will not be compensated for any failure to redeem/utilize on time. You will make best efforts to redeem early and do not leave it to the last minute to prevent system congestion, technical outage, and/or availability of the desired redemptions that may limit your ability to redeem in time.

You agree that the transfer of virtual currency and virtual goods is prohibited except where expressly authorized in the Service. Also, outside of the Service, you may not sell, redeem or otherwise transfer virtual currency, virtual goods, or user accounts of Wawa, to any other user of the Service or any other party.

You agree that in the event that these Terms of Service, your account or the Service is terminated for any reason, which may include without limitation our discontinuation for any reason of the applicable portion of the Service, you will forfeit all virtual currency and virtual goods, and we will have no liability to you for such forfeiture. In addition, if you have not used your virtual currency for twelve (12) months or more and your account has a virtual currency balance, your virtual currency may expire and your account may be cancelled for non-use.

Use of the term “purchase” in these Terms of Use does not imply that you obtain any ownership rights to the Service or any virtual currency or virtual goods.

Changes, Suspension or Termination of the Service

We reserve the right to add, change, suspend or discontinue the Service, or any aspect or feature of the Service, without notice or liability. You agree that we may alter the Service, which includes changing the various terms and changing or eliminating parts of the Service, without contacting you in advance.

You agree that we may temporarily suspend the Service without prior notice. During any such period you may be unable to access any information you have stored on the Service, or use any Wawa Coins, Wawa e-Tickets, or other virtual currency or virtual property. This may occur, for example, when we are conducting regular or emergency maintenance on the Service.

The license is effective until terminated by you or Wawa. Your rights under these Terms of Service will terminate automatically without notice from Wawa if you violate any terms listed in these Terms of Service regardless of whether the violation is by, on behalf of or through you. Upon termination of the license, you shall cease all use of the Service and delete all copies of the Service.

You may, as the result of termination, lose your Service account and all information and data associated with it, including virtual currency and virtual goods. You will not be entitled to any refund, reimbursement or other liability as a result of any termination permitted under these Terms of Service for any reason, whether by you or Wawa. Wawa reserves the right to refuse to keep accounts for or provide access to the Service to anyone.

Note that good 4G/5G coverage doesn't always equate to a fast and reliable connection to Picky Games; verify the speed and reliability of your cellular data connection using a speed test application.
